Agreement for Inspection Services
1. STANDARDS – Unless otherwise inconsistent with this Agreement or not possible, INSPECTOR agrees to perform the inspection in accordance with the generally accepted practices for home inspections.
2. VISUAL – This is a limited visual inspection of the readily accessible areas of the building. This report attempts to identify the condition of the noted items as observed at the time of the inspection and inform the client about major deficiencies in the condition of the property. Do not expect all deficiencies to be discovered in the inspection. Some will be elusive to the inspector. This inspection does not include techniques or procedures that are technically exhaustive or invasive. It is not intended to discover or include hidden or latent defects and deficiencies.
3. SCOPE – Unless agreed to in writing, the scope of the inspection shall be limited to the following: structural condition, basic electrical and plumbing systems, heating and air conditioning, general interior and general exterior, insulation and ventilation, and foundation and basement.
4. LIMITATIONS – The only components FUNCTIONAL are those listed in this report.
a. It is agreed that the components and conditions beyond the scope of the inspection include, but are not limited to: Environmental problems such as; any gas (including radon), mold, lead, underground tanks, formaldehyde; wood destroying organisms, wood destroying insects or other infestations; heat exchangers, radiant heating or solar systems; wells, water conditioners, septic systems, or irrigations systems; detached buildings other than garages or carports; low-voltage electrical systems of any type; pools, saunas, whirlpools or hot tubs; home appliances; air-quality control systems.
b. The inspection report is not a guarantee or warranty, either expressed or implied, as to the building’s condition or fitness for use.
c. This report is not a building code compliance inspection nor a certificate of any present or past codes or regulations.
d. It is understood and agreed that Efficiency Detectives, LLC, its officers and/or employees, assume no liability and shall not be held responsible for any mistakes, omissions or errors in judgment beyond the cost of the inspection. This limitation of liability shall include and apply to all consequential damage, bodily injury, or property damage of any nature.
e. Radon tests performed and results reported by companies on behalf of Winona Home Inspections are subject to the limitations of that company’s policies and practices.
5. USE OF REPORT – This report contains technical information. It is necessary for you to review the report with the inspector. If you choose not to do so, the inspection is not considered complete, and the inspector cannot be held liable for any uninformed misinterpretation of the report.
6. RADON Radon tests conducted by Efficiency Detectives, LLC are prepared for the sole, confidential, and exclusive use and possession of the client. It is not to be sold or transferred. Test results obtained in conjunction with this inspection pertain only to the dates identified in the radon report. Radon is a soil gas and readings are subject to seasonal variations and as such this inspector strongly recommends re-testing if the dated test exceeds 120 days to the closing of a real-estate transaction.
7. NOTICE TO THIRD PARTIES – The inspection and report are performed and prepared for the sole, confidential, and exclusive use and possession of the client. It is not to be sold or transferred. We strongly advise against reliance on this report by third parties.
8. NOTE – Should any element of this agreement be declared void it shall be stricken and the remaining provisions shall remain in full force and effect. This agreement constitutes the entire understanding of the parties with regard to this matter, and no statements, oral or otherwise, shall be enforceable unless in writing and signed by both parties.
9. SIGNATURE Your signature or an image of your check with signature included in this report is acknowledgement of the contents of the report and understanding of the disclaimer above.
